PROJECT RESOLUTION
FOR THE MEMORIAL AND HONOR OF THE VICTIMS OF
GENOCIDE IN SREBENICA
• Having regard to the Charter of the United Nations, the Geneva Conventions and Additional Protocols, the Convention on the Prevention and Punishment of the Crime of Genocide, the Rome Statute, the Universal Declaration of Human Rights, the Helsinki Final Act, the Covenant on Civil and Political Rights Policy, the European Convention and other documents of the United Nations, the Organization for Security and Co-operation in Europe and the European Union on Human Rights;
• Referring to the Judgment of Appeal, Case No .: IT-99-33, 19 April 1993 by the International Criminal Tribunal for the former Yugoslavia, where the Srebrenica massacre was recognized and recognized as genocide; The appeal decision of the International Court of Justice of 26 February 2007, which finds that the acts committed in and around Srebrenica around 15 July 1995 are acts of genocide and that they should be called by their real name: Genocide; Judgment of the International Criminal Tribunal for the former Yugoslavia in Case no. IT-09-92-T, 22 November 2017 and the decision of the Appeal of the Permanent International Mechanism for Criminal Courts in the case MICT-13-56-A, 8 June 2021;
• Based on UN Security Council Resolutions 827 of 25 May 1993, 1551 of 9 July 2004 and 1575 of 22 November 2004;
• In full compliance with the European Parliament resolutions of 7 July 2005, 15 January 2009 and 15 July 2015 on the Srebrenica Genocide Remembrance and the assessments of the Council of Europe report of the European Commission against Racism and Intolerance, ECRI, adopted March 22, 2017;
• Unanimous with the statements of the High Representative of the European Union for Foreign Affairs and Security Policy and at the same time the Vice President of the European Commission, Mr. Josep Borrell, as well as the Commissioner Olivér Várhelyi on the genocide in Srebrenica;
• In support and implementation of the priorities of the Republic of Albania set for the mandate in the Security Council of the United Nations for the period 2022-2023 as well as the work program of the Albanian Presidency of the Security Council for June 2022, which has in center for respecting international law and strengthening accountability for serious violations of international law and in the spirit of the UN Security Council High Level Open Debate on “Strengthening Accountability and Justice for Serious Violations International Law ”, developed on June 2, 2022;
• With an unwavering willingness to contribute to the preservation and strengthening of peace, security and democratic values in Europe, especially in the Western Balkans region;
THE ASSEMBLY OF THE REPUBLIC OF ALBANIA
– Confirms Albania’s position that the denial of the genocide committed against the Bosnian population in Srebrenica by Bosnian Serb forces constitutes a violation of international law, promotes the phenomenon of impunity for war crimes and violates the dignity of more than 8 thousand civilians who were massacred in Srebrenica, survivors and their families, but also against some 10,000 Albanians killed during ethnic cleansing in Kosovo and 20,000 women raped by Slobodan Milosevic’s Serbian regime;
– Expresses its deep sorrow for the victims and human trauma caused by the Srebrenica genocide, as well as its full understanding and sincere sympathy for all those injured during the bloody war in Bosnia and Herzegovina;
– Strongly condemns any tendency and action to publicly deny, intentionally or not, the genocide committed in Srebrenica, concealment of motives, praise of the perpetrators, creators and supporters of this genocide, and considers unacceptable and extremely dangerous the continuation and escalation of nationalist political rhetoric, incitement to ethnic hatred as a result of denial of the Srebrenica genocide, massacres and other crimes against humanity committed throughout the former Yugoslavia by some individuals, groups, and political and media actors inside and outside the region. Balkans;
– Joins the assessment that the attitudes of candidates for EU membership should be fully in line not only with the EU acquis, but also with the EU Common Foreign and Security Policy, in line with those principles and values set by the European Union and all democratic countries, according to which the public denial and non-condemnation of the Srebrenica genocide is incompatible with European values and aspirations;
– Calls on all member states of the United Nations and international and national bodies of justice to increase their commitment and serious efforts to prosecute and punish war criminals and their accomplices responsible for genocide and other crimes war.
Calls on the European Union, NATO and each of their member states to work intensively to accelerate the enlargement process, as a guarantee for the consolidation of democratic values, peace and security in the Western Balkans region, Europe and beyond. .
– Expresses full support for the attitudes, actions and measures taken by the Albanian Government in support of the principles on which European security is built, and the global order of relations between states.
Appreciating and supporting the serious, professional and high-level commitment of the Albanian Government in fulfilling the role of Albania as a non-permanent member of the United Nations Security Council for the period 2022-2023, urges the Government to:

– Continue its commitment to upholding the principles and norms of international law and strengthening accountability for its grave violations, in close coordination with all allied and partner countries of the Security Council, the EU, the OSCE and the Council of Europe ;
– To honor the victims of the genocide in Srebrenica and, referring to the decision of the European Parliament, to declare July 11 as the Day of Remembrance of the Genocide in Srebrenica;
– To give its full contribution in support of the deepening of reforms and democratic processes for the consolidation of a society ruled by law, justice and protection of human dignity, the spirit of regional cooperation, good neighborliness and European integration, as the only way to overcome hatred and division, to promote justice on the basis of which peace, security and reconciliation are built between the peoples of the region, Europe and beyond.
– Work tirelessly to strengthen good neighborly relations with other Western Balkan countries, in the spirit of mutual respect, principles of equality, spirit of reconciliation and understanding to build a common just future, strengthening political ties , economic and trade between countries as well as contacts between people, for the benefit of peace, security, economic and social progress for each country and the region as a whole.
