A court in Australia has ordered Google to pay a former lawmaker about 480 thousand euros as compensation for defamation for two videos posted on YouTube.
The Australian Federal Court recently found that two videos pushed John Barilaro, the deputy prime minister of Australia’s most populous state, New South Wales, to leave politics prematurely.
Judge Steven Rares said the videos, which were posted by political commentator Jordan Shanks, constituted a ruthless, racist, swearing, abusive and defamatory campaign against Barilaro. The judge said:
The videos questioned the former lawmaker’s integrity, including his “corrupt” labeling without evidence, and called him racist names that were nothing less than hate speech.
He found that Google earned thousands of dollars from the two videos, but failed to implement its policies to prevent hate speech. The videos have been viewed nearly 800,000 times since they were posted in late 2020. When Barilaro left politics in October 2021, it was because he was traumatized by the Google campaign and this caused him to leave the political post prematurely.
Google’s conduct in this process is inappropriate and unjustifiable.
