Lawyers for Alec Baldwin and other Rust producers are asking the court to drop a lawsuit filed by screenwriter Mami Mitchell, who was filming when the Hollywood actor fired a shot that killed cameraman Halina Hutchins.<\/p>\n<\/div>\n
In a submission to the Los Angeles Supreme Court, lawyers said Mitchell’s lawsuit should be dismissed as there is no evidence that Baldwin or any of the manufacturers intended to cause harm, Reuters reports.<\/p>\n
“Despite the prosecutor’s attempt to declare the charges intentional, there is nothing to indicate that any of the accused has intentionally committed harmful behavior,” the lawyer’s submission reads. Mitchell claims in a lawsuit filed in November that Baldwin should have checked himself if the weapon was loaded with real ammunition and not rely on the assistant director who claimed the Colt 45 revolver was safe to use.<\/p>\n
Instead, in our opinion, Baldwin chose to play “Russian roulette” when he fired without controlling it. “His behavior and that of the producers was reckless,” said the lawsuit, which Mitchell filed in the Los Angeles Supreme Court for causing emotional stress and intentional harm.<\/p>\n
Gunner Hannah Gutierrez-Reed and Assistant Director Dave Halls were also mentioned in her lawsuit. Halina Hutchins was killed and Joel Souza was wounded during the filming of “Rust,” in New Mexico on October 21, 2021, when Baldwin fired a live ammunition.<\/p>\n
