The reaction of the lawyers to oppose the new court map has passed to another level after for 10 days the lawyers have announced that they will boycott the hearings for imposing the security measure.
But during this Thursday, not all lawyers implemented the decision of the National Chamber of Advocates, claiming that they were not officially acquainted with this decision.
For its part, the Chamber of Advocates has warned that lawyers who do not implement the decision will face sanctions that go as far as the revocation of the advocacy license.
In the court of Tirana this Thursday was held the security measure for 5 arrested, 2 for opposing the police forces and 3 for driving under the influence of alcohol.
Meanwhile, more than 60 court hearings were postponed at the request of lawyers.
A 34-year-old man from Yzberishi, who has been under house arrest for 6 months, came to hold the next session this Thursday, after causing a drunken accident and damaging 3 parked cars. The absence of a lawyer due to the boycott, but also of the judge dismissed from the vetting, brought the young man back home accompanied by police officers.
The same situation occurred in the district courts where hundreds of hearings were postponed due to the boycott of lawyers and only in sporadic cases the security measure was developed.
The Lawyers’ Boycott leads the court to a stalemate as any security measure given without the presence of a legal counsel becomes invalid. Within 48 hours from the detention or arrest of the person, the prosecutor submits the request for the security measure to the court, which within another 48 hours must make a decision.
In the evaluation sessions of arrests, detention, etc., the presence of the defense counsel is mandatory as a right of the person and non-participation makes it impossible to hold hearings according to the provisions of the Code of Criminal Procedure.
