On July 6, Fatos Tushe was handcuffed by the SPAK for abuse of office on charges of abusing public funds for a tender worth ALL 24 million.
The Special Prosecution, SPAK also ordered the arrest of 4 subordinates of Tushë and two businessmen, while four other officials of the Municipality of Lushnja were left in the measure of “Home arrest” by the court.
The SPAK launched an investigation a year ago, based on a Judicial Police referral for the criminal offenses of “passive corruption”, “violation of equality in tenders”, “abuse of office” and “falsification of documents”.
The former mayor of Lushnja appealed to the Constitutional Court the decision of the Council of Ministers that removed him from office.
On December 21, the trial panel is expected to consider the lawsuit of the former socialist mayor, who is seeking reinstatement even though he has been in detention cells for months accused of corruption.
Tushe, a former Socialist Party MP, has run the Municipality of Lushnja since 2011.
On December 31, 2019, Tushe was injured after a grenade was thrown at his office by a former municipal driver.
He is one of the highest-ranking officials arrested so far by the SPAK, and the operation was commented on by US Ambassador Yuri Kim and Prime Minister Edi Rama.
The latter did not delay and within 24 hours signed the dismissal of his socialist elected.

In this procurement procedure, conducted by NPP Municipality of Lushnja, in 2020, legal violations have been identified, committed by citizens GN, acting Deputy Mayor and LS, acting Director in the Procurement / Legal Directorate, which form elements of the criminal offense of “Violation of the equality of participants in public tenders or auctions”, committed in collaboration, provided by Articles 258 and 25 of the Criminal Code.
The persons under investigation GN and LS in cooperation with other persons under investigation, the Mayor FT, the director of this enterprise FP, etc., have made it possible for this procurement procedure to be won with documentation by the company EURO – ALB shpk, with representatives BM , creating advantages for this entity during the procurement procedure.
Also, the persons under investigation GN and LS have committed illegal actions during the other three procurement procedures, organized by the Public Property Enterprise of the Municipality of Lushnja, such as:
1. “Purchase of Asphalt concrete – Framework agreement – with an economic operator where all conditions are defined – for a period of 30 months”;
2. “Purchase of electrical materials – Framework agreement – with an economic operator where all conditions are defined – with a term of 24 months”;
3. “Purchase of concrete and gravel – Framework agreement – with an economic operator where all conditions are defined – for a period of 24 months”,
In all these procurement procedures it was ascertained that the procedure of compilation / submission of documents of these tenders and the procedure of bid evaluation was performed by the persons under investigation GN and LS and not by the members of the PU and KVO, performing a fictitious procedure , organized and executed by the persons under investigation GN and LS, and qualifying EO predetermined and with higher financial offers.
At the request of the Special Prosecution, the Special Court of First Instance for Corruption and Organized Crime with decision no. 101 dated 11.12.2021 has imposed personal security measures “Prison arrest”, for citizens:
• GN, acting Deputy Mayor of Lushnja, suspected of committing the criminal offense of “Abuse of duty” in cooperation, “Violation of the equality of participants in public tenders or auctions”, committed in cooperation, according to articles 248-25 , 258-25 of the Criminal Code.
• LS, acting Director of the Procurement Directorate in the Municipality of Lushnja suspected of committing the criminal offense of “Abuse of duty” in cooperation, “Violation of equality of participants in public tenders or auctions”, committed in cooperation, according to articles 248- 25, 258-25 of the Criminal Code.
Today on 13.12.2021, the State Police has executed the security measures set by the Court with decision no.101 dated 11.12.2021.
Also, pursuant to the decision no. 483 dated 12.12.2021 of the Special Court of First Instance for Corruption and Organized Crime, the Judicial Police at the State Police has exercised controls in several apartments and offices of the investigated subjects.
