The High Prosecution Council decided to appeal to the High Court to challenge the court decision that upheld Sonila Muhametaj and ordered the re-ranking of the three candidates Muhametaj, Alfred Shehu and Elvin Gokaj.
With the request for suspension of the execution of the decision and abrogation of the decision, KLP refused to comply with the final decision of the Administrative Court of Appeal which challenged four decisions taken within a day by the prosecution government to promote in the career and to bring two prosecutors to the SPAK and disqualify Muhametaj.
At a time when the court emphasizes that the exclusive right to send prosecutors to the SPAK belongs to the HJC, the court criticizes the government of prosecutors for not following the procedure in this case and for flagrantly violating legal principles.
The Administrative Court adds that the acts for sending two prosecutors to SPAK, Shehu and Gokaj, are absolutely invalid. However, the KLP recourse to the High Court saves them from the moment of suspension to be subjected to scoring again in front of Sonila Muhametaj. And also the KLP that leaves the case in a court that has a stock of 36 thousand files.
Including Gokaj and Shehu, the SPAK currently has 17 prosecutors, but one of these positions continues to target Muhametaj, a prosecutor with a 17-year career who insists the selection of rivals was influenced.
