The Democratic Party on Saturday filed a complaint with the CEC to repeal the decision to register the “House of Freedom” coalition in the March 6 by-elections.
In the complaint of the Democratic Party, it is stated that the Socialist Movement for Integration has submitted a request with the object “Request for registration with the CEC of the electoral coalition.” Attached to this request, says PD, is the authorization for Mr. Endrit Braimllari and the coalition agreement.
Whereas, with decisions no. 34 and no. 38, dated 02.02.2022, the State Election Commissioner has decided to register the electoral subjects of the Socialist Movement for Integration and the Christian Democratic Party. From the above, it is clear that at the time of submitting the application for registration as an electoral coalition, neither of the two political parties participating in this coalition were registered as electoral subjects.
Article 65, point 1 of the Electoral Code, as well as article 2 of Instruction no. 1/2020 of the Commissioner, clearly defines how an electoral coalition can be registered only two or more political parties registered as electoral subjects in the CEC.
Whereas, point 9 of decision no. 2, dated 22.01.2022 of the Regulatory Commission had clearly provided that the requests for registration of the electoral coalition are submitted within 24 hours from the approval of the requests for registration of political parties. The election law and its bylaws do not recognize concepts such as “ahead of time”, but only within or outside the deadline.
