Olsian Çela has entered the third year of his 7-year term as the first general prosecutor to lead a decentralized indictment. But it seems that he does not agree so much with the weakening of that power in the accusation that all his predecessors had in full, up to Adriatik Llalla, the last general prosecutor before the reform.
Unlike last year’s report when it suggested control of chief prosecutors in judicial districts, a year later the KLP party the attorney general expressed the same desire in another form. This time Cela demanded control of the preliminary judge, to whom the law has given authority over the work of prosecutors whose investigations are decided by the prosecutor and not the chief prosecutor, whether to go to trial or other investigations.
If a judge once comes out as a judge and once as a prosecutor, forgive me now but what is the solution you will see as a judge or prosecutor? There is nothing wrong with reviewing laws, it does not mean that it is illegal and I think that is the solution, to look at the powers of investigation at the preliminary stage
But what the Albanian chief prosecutor Olsian Çela wants is one of the 3 main pillars of the 2016 reform, which brought a weak general prosecutor and in front of him all the other strong and independent prosecutors during the investigations controlled by the preliminary judge. It is precisely the role of the pre-trial judge ordered by justice reform and copied by European Union standards that is challenged for the second time in some form by the number one accuser who is apparently not yet ready to accept his role.
“The role already given to the pre-trial judge makes him and the investigator in charge, and this judge orders the wiretaps and the investigator, a judge who does not take into account a number of circumstances that are taken into account in decision-making.” said Olsian Çela.
On the other hand, during the annual reporting, Cela announced that there are only 205 prosecutors left, while 116 are considered vacancies created by vetting.
The members of KLP received and escorted the General Prosecutor Olsian Cela in calmer tones than those of last week when the Chief Prosecutor of SPAK Arben Kraja was questioned with criticism by both governments, both his government of the prosecution and the government of the majority.
“I have no opinion about SPAK, whoever evaluates it has special bodies” – said Olsian Çela.
