Democrats demand the removal of the mandate of the deputy minister Olta Xhaçka. Through a letter submitted to the Assembly, the parliamentary group of the Democratic Party intends to set in motion the legal mechanism that will examine the legality of the mandate of the foreign policy chief.
In the motion of the initiative group led by Gazment Bardhi, signed by 14 Democrat deputies, it is claimed that Minister Xhaçka is in violation of her mandate because her husband has obtained the status of strategic investor in violation of the Constitution.
“The parliamentary group of the Democratic Party, in accordance with Articles 70 and 71 of the Constitution and Article 13 of the Rules of Procedure of the Assembly, requests the immediate meeting of the Council for Rules of Procedure, Mandates and Immunity, to review the incompatibility of the mandate of MP Olta Xhaçka. asks the Assembly to decide on sending the case for review to the Constitutional Court”.
The Democrats’ move came minutes after the Socialists thwarted the opposition’s next attempt to launch a parliamentary inquiry.
“The SP wants to protect the government officials who are involved in this affair“, Said Alibeaj.
“You had no facts, the request was contrary to the Constitution“, Said Balla.
In the past, the Constitutional Court has issued various rulings on cases related to incompatibility of the mandate. The Socialists Ilir Beqaj in 2011 and Koço Kokëdhima in 2016 lost their mandate after it was proved that they had benefited from public money under the guise of MP. Something like this did not happen with Rakip Suli and Valentina Leskaj, where the former socialist MP can be considered a similar case, but not similar to Minister Xhaçka
Leskaj was accused that her sons had won a public tender from the government. The court at the time found that Leskaj was not responsible for the children, who were adults and had their own family crowns. One thing that cannot be said in the Xhaçka case.
