Fiks Fare / Judge fired by KPC confuses their last name for 13 years. The family loses compensation from the state

This intentional or unintentional change of the family surname has cost them the loss of compensation they would receive from the state for their properties flooded by Lake Fierza in Kukës.

In Fiks Fare complained Afrim Imeri showing that Mrs. Fahrije Vata has twice been a judge in the Imeri family case and once in the role of prosecutor.

“The story begins with the decision to open our family’s inheritance in 1999. My uncle has filed a lawsuit for opening proof of inheritance, in the trio of judges is Fahrije Vata. The court decides by changing the surname of my grandfather Zeqir IMERI to Zeqir KURTI. It was intentionally wrong because all the pages of the decision say Imeri and in the end says Kurti. From Zeqir Imeri to Zeqir Kurti !!! “Says Afrim.

According to the documents submitted to the court by the Kukës District Council, the surname Imeri is mentioned, and never Kurti. Surprisingly, the complainant says that this judge returns to another case of the Imeri family, for the lawsuit of reinstatement in time. Afrim’s uncle also filed a lawsuit with the surname Imeri, but surprisingly the file of this decision has disappeared. This is confirmed by the court of Kukës in a letter. In addition to the change of the surname of the Imeri family, the number of the criminal report also turns out to be wrong. Mistakes which the Kukes Prosecution considers to be the mistakes of Mrs. Vata.

Afrim seeks the help of Fiks to find out how true it is, as according to him someone has benefited by harming his family. “We are not given the documents of the file, because the file has been destroyed without legal grounds” says the denouncer and in these conditions they have addressed a report to the prosecution for the destruction of the file without legal grounds by the Kukës Court.

At that time, Mrs. Kukës had become part of the Prosecution. Vata was transferred from a former judge to a prosecutor. The Imeri family’s report was sent to prosecutor Fahrije Vata for investigation.

Again Mrs. Vata errs again with the surname turning it into Hasani.

“I file the report, my name is APRIM IMERI. The prosecution, let alone investigating, is also altering my last name. As if that were not enough with the former, he abuses the letter of the General Prosecutor’s Office. The decision states that the complainant Afrim Hasani, born in Has, resident in Yrshek, has sent a letter to the General Prosecutor’s Office, report 147/1. Adds the complainant. Another mistake that leaves much to be desired is that the report starts with No. 438, but ends with No. 3438. While the complainant states that in the decision of the prosecutor sent by mail to him after 4 months, the recipient Afrim Zeqir Imeri is clearly visible on the envelope. So the prosecutor does not err in writing the correct surname on the envelope, but in the document yes. Fiks Fare asked the Court of First Instance in Kukës for information on the problem of the Imeri family

The Court of Kukës, in its response, clarifies that Ms. Fahrije Vata has exercised the duty of assistant judge at this court for the period July 1994 until June 2000.

Regarding the errors of surnames, the Court says that in the part of the enacting clause of decision no. 95 dated 09 April 1999, the surname ‘Kurti’ is found to be established. The decision-making and reasoning of the decision is the right of the trial panel of the case and the ways of challenging or correcting the civil decisions of the courts are precisely defined in the Code of Civil Procedure.

For the destruction of the file, the court states that the civil request with the object of opening an inheritance certificate, with the citizen Avdi Ymeri as applicant, was sent for permanent storage in the Central Archive of the Justice System in Tirana.

The civil request “Resettlement on time”, with applicant Avdi Ymeri, is saved according to the deadlines set based on the Order of the Minister of Justice no. 4895/5, dated 01.11.2016.

So the reset file on time has been destroyed. But, according to an exchange of letters between the complainant and the Ministry of Justice, the latter writes that the property files are in permanent storage. The Kukës Court has acted contrary to the instructions in force, forcing the citizen to file a criminal complaint with the Kukës Prosecutor’s Office. But the report also fell into the hands of the former judge, Fahrije Vata.

Meanwhile, Fiks Fare tried to communicate with prosecutor Fahrije Vata. But the Kukës Prosecutor’s Office confirmed that the prosecutor had a report. The chancellor asked about the changes of the surname in the report from Imeri to Hasani explains it as technical errors. Fiks journalists tried to communicate with prosecutor Vata themselves but did not receive a response from her.

Meanwhile, a few days ago, the Independent Qualification Commission announced the decision to dismiss the prosecutor of Kukes, Mrs. Fahrije Vata. The decision to dismiss was made based on the problems found with the property.

After this decision, the Kukës Prosecutor’s Office responded to the show Fiks Fare regarding the problem of the whistleblower Afrim Imeri. As for the mistakes regarding the surname and the number of the criminal report, made by Mrs. Vata, the prosecution considers them slips.

But for these slips of Mrs. Vata with the surnames of the plaintiffs and the accused, by Hasani and Kurti, the Imeri family lost the compensation they owed from the state for their properties.
