The mission of the prosecution is to serve the public by acting responsibly, impartially and objectively, to protect the rights of the individual, but in this case this is not the case.
Fiks Fare denounced the actions of the prosecution which, despite all the evidence, dismisses the case and blames the victim. Even the evidence is not even in the final file justifying that they have been lost.
Marjeta Xhimaku complains on the show Fiks Fare about an accident that happened to her 68-year-old mother in the Ali Demi neighborhood, an accident that took her life. She points out that at that time they did not deal with the person who caused the accident because they thought that the authorities would do their job and the person would be found guilty. Aware that this did not happen, they only became aware when the prosecution asked the court to dismiss the case, finding the victim guilty.
The ‘killed’ relatives for the second time have asked the prosecutor for the file. “We saw that there were many shortcomings, in the file were only the images of one banker and not the other who had a clearer view of the accident that occurred,” says Marjeta. In these moments she claims that they had begun to doubt what had actually happened, as the person who had committed the accident this was not the first time. He also injured another woman, resulting in death, almost in the same place. Unable to find support in the institution she was supposed to support, the prosecution, she turns to Fiks Fare to put justice in place.
Fiks Fare provided the victim’s accident file, analyzing the acts of expertise as well as the film footage. In the first act of expertise performed by a single expert it is clearly stated that the driver of the engine violated the rules of the road by not controlling the speed in residential areas, but that the speed could not be measured. Meanwhile, the driver of the motorcycle that caused the accident in his statement claims that he was stopped and the elderly woman collided with him, as a result of which he died. Thus, even though the expert wrote that the traffic rules were violated, he found the victim guilty, with the motive that he did not cross the white lines.
Plus what is written in this file contradicts each other. At the scene, it is said that traces of braking and pieces of glass were found, but only a few lines below it is said that no trace was found.
From the film footage that Fiksi provided of the accident of one of the banks, footage that is also in the file, it can be seen that the engine was not in his lane and did not brake before as written in the minutes, but went and hit the elderly woman. So it was not the elderly woman who collided with the motorbike, but the latter collided with the victim. Also in these videos that are in the file of the prosecution which has requested the dismissal of the case, it is clearly seen how the scene was destroyed. The engine that carried out the accident was moved from the scene, and blood stains were washed on the asphalt. But for the experts it still does not constitute a violation, they write in the file that they have looked at the images of both banks, but that in fact does not turn out so. Family members in the file have found only the film footage of one bank and the OPGJ itself, Kastriot Canaj has confirmed that the footage of the other bank has been lost in the secretariat of the prosecution and according to him this happens often.
Contacted by family members, two experts Lekë Gjoni and Arqile Lipe admit that they saw the film footage of only one bank, but that they wrote in the file that they saw the cameras of both banks.
After numerous attempts by the victim’s relatives, one of the experts leads them to another camera frequency that is not in the file, claiming that the officer sent it to the judicial police. Thus reconfirming that when they made the act they did not see the other camera and why they wrote that they saw the cameras of the two banks.
Fiks Fare addressed for a more professional opinion the President of the Association of Experts in Assistance to the Accident, Mr. Gëzim Hoxha, who says that looking at the cameras it is clear that the culprit of the accident is the driver of the engine.
