The International Court of Justice today announced the opening of investigations into possible war crimes committed by the state and the Israeli army in the Palestinian territories since 2014.
The move was welcomed by the Palestinian Authority.
“Today I confirm the launch from the prosecutor’s office of the International Court of Justice of the investigation into the situation in Palestine.” said in a statement Fatou Bensouda, the court’s chief prosecutor, adding that the investigation would be conducted “independently, impartially, objectively and without fear or favor”.
Despite fierce opposition from Israel, the Hague tribunal ruled last month that it had jurisdiction to investigate serious crimes in Palestine, opening the door to the formal launch of investigations by Bensouda.
The decision comes after in 2019 Bensouda declared that it had “Reasonable grounds” for war crimes investigations into Israeli military operations in the Gaza Strip and West Bank territories, including East Jerusalem, and therefore called on judges to determine the jurisdiction of The Hague in Palestine.
In addition to Israeli actions, Bensouda said actions related to Hamas or other Palestinian armed groups would also be investigated.
Palestinian territories have been occupied by Israel since the 1967 conflict. Israeli Prime Minister Benjamin Netanyahu called the decision “political and not legal.”
