A judge has decided that the man did not rape the accusing woman after she had left the door of the toilet of the bar half open where the incident took place.
On the night of the incident, the girl had gone to the toilet, in a bar in the center of Turin in the north of Italy, in May of last year.
But the judge says that the girl was in a high mood after consuming a significant amount of alcohol and the fact that she had left the toilet door half open was an “invitation” that had caused the man to approach her for contact.
Entering into other intimate details, he told the court that the zipper of the girl’s pants was broken, leaving it open.
But officials overturned the two-year sentence for rape, arguing that “the chain was old and worn, and had not broken as a result of the attack.”
Italian MP Laura Ravetto chimed in with her own criticism, calling the case ‘horrifying’.
She said: “The girl has voiced her disapproval of sexual intercourse and perhaps by leaving the door half open she encouraged the man to ‘dare to do it’.” It’s terrible.”
Opponents of the decision said they hope the case will be heard in the high court and that the decision will be overturned.
In 2017 – also in Turin, a man escaped charges of raping a colleague after the judge said she had not objected to him and had not screamed for help.
