The Constitutional Court (CC) in Albania overturned the decision of the Parliament to dismiss the President of the Republic, Ilir Meta, whose term ends in July this year.
The decision of the Constitutional Court in Tirana was published in the late hours of Wednesday evening (16.02). The Constitutional Court ”decided to repeal the decision of the Parliament:“ On the dismissal of the President of the Republic of Albania for serious violations of the Constitution. ” According to her, the head of state has not committed serious violations of the Constitution.
In June last year, Parliament voted in favor of ousting the President for “public statements inciting violence and violating the Constitution.” This decision was overturned last night by the CC, which in three plenary sessions, held earlier this month, listened to both parties: the parliament and the presidency and ruled that President Meta should remain in office.

The trial in the CC has resulted in a win-win in relation to the Constitution. As the procedures followed by the Parliament for the dismissal of the head of state are in accordance with the Constitution – on the other hand, the head of state, President Meta has not committed serious violations of the Constitution.
One of the strongest points of the defense of the legal representatives of the head of state in the CC was the allegation of serious procedural violations by the Parliament since the review of the legal initiative of the socialist majority to dismiss Meta, the establishment of the investigative commission and the decision to dismiss. The CC rejected these allegations. In her announcement, she states that “considering the organizational independence of the Parliament, it finds that there are no constitutional violations as a whole.”
President Meta himself, who did not appear at any of the CC plenary sessions where his political fate would be decided, called Parliament’s decision to dismiss him “unconstitutional and ridiculous” when it was announced in June last year. .
Argumentation of the Constitutional Court
The CC also rejected the claims of the socialist majority “for serious violations of the Constitution” by President Meta. “The facts presented for divisive messages, taking the side of the opposition during the election campaign for the parliamentary elections of April 25 last year, for violation of public order and security, the oath as head of state to represent the unity of the people, for violating “Relations with Albania’s strategic partners, for violations of the independence of public bodies, public order and security do not constitute violations of the Constitution”, it is emphasized in the announcement of the CC.
