The Special Court confiscated the assets of Democrat MP Kasem Mahmutaj as unjustified, following a SPAK property investigation into the assets of his brother Gazmend Mahmutaj, a convicted man in 1993 on charges of exploiting prostitution in Italy.
In the decision announced by Judge Etleva Deda, 22 properties confiscated from the three Mahmutaj brothers are counted, among which are the properties of the deputy. Sources told Top Channel that MP Kasem Mahmutaj, by court order, transferred two apartments, two plots of land and a vehicle in favor of the state.
Although declared as income from emigration, the court assessed that the assets of Behar, Kasem and Gazmend Mahmutaj are not justified and that there are suspicions stemming from the crime as long as the latter is convicted. The brother of MP Gazmend Mahmutaj with the changed name to Eduart Toska turns out to have been found guilty by the Court of Verona in November 1993.
This decision on the charge of exploitation of prostitution was converted in Albania with eight years in prison in the same year. While in 2020 the assets of the convict and his family were placed under the control of OFL and then the search of SPAK who went to court with a request for blocking. The MP and his two brothers were left without confiscation of only one apartment that was tolerated by the Court for social and housing reasons.
