The Constitutional Court has decided to proceed to a public hearing of the case filed by the Albanian Committee of Helsinki, regarding the request for the repeal as incompatible with the Constitution of the Republic of Albania of Article 89/b and 242/a of the Criminal Code.
The articles criminalize certain forms of citizens’ disobedience to the measures of competent state bodies during a state of emergency or a state of natural disaster.
The Albanian Helsinki Committee claims that the change in the code cannot justify the purpose if the principles are violated.
