The Assembly of the Council of Europe may decide to prepare and debate reports – including follow-up reports – on any subject that falls within the mandate of this Council.

This is how the Council of Europe answered, to the question of Radio Free Europe, whether it will take into account the Resolution of Albania, which aims to reject the accusations of trafficking in human organs during the war in Kosovo, which stem from the senator’s report Swiss, Dick Marty.

On July 21, the Assembly of Albania unanimously voted, with 125 votes of the deputies, the Resolution, with which it aims to reject the accusations of trafficking in human organs during the war in Kosovo, which stem from the Marty report.

The resolution calls on the Parliamentary Assembly of the Council of Europe to produce a follow-up report and therefore a review of the Council of Europe Resolution, reassessing the claims of illegal trafficking of human organs in Albania and/or Kosovo , in the light of the developments that have taken place during this decade, the facts, evidence and updated information, as well as in terms of the commitment, readiness and full cooperation of Albania and Kosovo in the service of the truth and the establishment of justice.

The 2010 report, drafted by Dick Marty and approved by the Parliamentary Assembly of the Council of Europe, claims that the leaders of the Kosovo Liberation Army were involved in organ trafficking during the 1998-99 war.

These claims were investigated by US Attorney Clint Williamson, who in July 2014 announced that his team’s findings did not include evidence of organ trafficking, but of other war crimes.

This, in 2015, led to the formation of the Kosovo Specialized Chambers to investigate alleged crimes by KLA members against ethnic minorities and political rivals, allegedly committed between January 1998 and December 2015. of the year 2000.

The Prime Minister of Albania, Edi Rama, whose party sponsored the Resolution, said on July 21 that the allegations made by Dick Marty about “killing people with the purpose of extracting and selling their organs and illegal trafficking of human organs in Albania and Kosovo”, are claims that “have remained unargued, unapproved and not based on evidence and facts”.

The Council of Europe is an international organization for human rights, democracy and the rule of law in Europe, headquartered in Strasbourg, France.

The Council protects freedom of expression and media, equality and minorities in member countries.

What does rule 25 provide for?

This rule stipulates that a motion for recommendation or resolution – with no more than 300 words – must be signed by at least 20 representatives or alternates, belonging to at least five national delegations, or must be approved by the necessary quorum of the committee.

In the Specialized Chambers in The Hague, otherwise known as the Special Court, the process has already started against some former leaders of the KLA, including: Hashim Thaçin, Kadri Veselin, Rexhep Selimin and Jakup Krasniq.

They have been in custody in The Hague since November 2020.

War crimes and crimes against humanity are mentioned in the indictment against them, but “trafficking in human organs” does not appear.
