A couple who claimed that the malicious neighbor had placed a mannequin in the window of his attic that “looked” from their bedroom, has lost their appeal in court in Britain.
Stylist Rosie Taylor-Davies, and husband Christopher, said they were forced to change behind a bookshelf and stay in the dark or with curtains closed after their neighbor, Simon Cook, opened a window overlooking their bedroom.
They told the court that the window was not made of ice glass as provided by the municipality, but moreover their malicious neighbor placed there a ‘blonde’ mannequin that seemed to be eavesdropping all the time from their house.
The judge consequently ruled that Mr. Cook was not concerned about their neighbors’s privacy concerns but his window did not violate the building planning rules.
Mr. Cook had applied for the construction of his attic with folding windows, and Mr. Taylor-Davies had complained of violating their privacy with the new window on the third floor.
But Wandsworth City Council granted Cook’s construction request and determined that the attic window should have dark ice glass with no opening option.
The council later abandoned this rule, arguing that “the window looked out of the sky.”
The two houses stand on a sloping road and Cook’s stands higher than the neighbors, Whale argued, adding that anyone looking out of the attic window overlooks the Taylor-Davies family bedroom and shower.
While Cook’s decision to install the mannequin, according to the lawyer “serves to give the impression that a person constantly monitors their home while violating privacy. This greatly increases the stress of the people who live there.
Speaking after the ruling, Mr Taylor-Davies said they were considering moving out of the house where they had lived for more than 20 years.
