Following today’s verdict in the trial against Hysni Gucati and Nasim Haradinaj, Special Prosecutor Jack Smith expressed his commitment to investigate and prosecute with vigilance all cases of witness intimidation, retaliation against witnesses and obstruction of justice.
The statement said that Smith stated that justice has been done today against Gucat and Haradinaj, after they were found guilty.
“Justice has been served today. “Mr. Gucati and Mr. Haradinaj have been found guilty of their crimes, after a transparent, careful and fair trial of this important case,” said the Specialized Prosecutor.
“Intimidation or revenge against these victims is, in my opinion, a very serious crime that strikes at the heart of the ability of this institution to provide justice and the rule of law. “If you try to intimidate or retaliate against the witnesses of this court, I will do everything in my power to ensure that you are brought to justice.”
The Specialized Chambers found Hysni Gucati and Nasim Haradinaj guilty of obstructing the administration of justice, sentencing them to four and a half years in prison each and a fine of 100 euros.
The defense teams of Nasim Haradinaj and Hysni Gucati confirmed to reporters that they will appeal the sentencing verdict for the two defendants, handed down on May 18 by the Specialized Chambers in The Hague.
The guilty verdict can be appealed by the parties within 30 days to the panel of the Court of Appeals in The Hague, which operates under the laws of Kosovo.
The Specialized Chambers and the Specialized Prosecutor’s Office – otherwise known as the Special Court – investigate alleged crimes committed by members of the Kosovo Liberation Army against ethnic minorities and political rivals from January 1998 to December 2000. .
