Saimir Tahiri should be found guilty of “involvement in a criminal group” and “drug trafficking”, argues SPAK in its recourse to the Supreme Court.
Journalist Anila Hoxha has provided the document where SPAK says that adocuments and evidence accepted by the court, the qualification as abuse of office is wrong and the crime committed as trafficking within the structured group should be considered:
“The court erroneously argues in the decision that from the evidence presented by the prosecution in the file of the trial they fail to prove beyond any reasonable doubt the agreement between the defendants Saimir Tahiri and Jaeld Çela and at least one of the defendants in related proceedings. , Moisi Habilja, Florian Habilaj, Sabaudin Çelaj, Maridian Sulaj, Sokol Bode, Gjergji Kohila, etc., to commit the criminal offenses of narcotics trafficking or to identify and prove concrete actions committed intentionally by the defendants Saimir tahiri and Jaeld Çela, in the framework of an agreement to assist the criminal group of Moisi Habilaj in the execution of concrete episodes of trafficking in which narcotics were seized “
Further, listing the evidence that the court has examined, the Special Prosecution argues that “the court has assessed and evaluated the above-mentioned evidence and facts and erroneously argued that it does not prove beyond any reasonable doubt the cooperation and existence of the defendant Saimir Tahiri , participants and members of this criminal group…. from evidence and facts The role and cooperation of the defendants Saimir Tahiri and Jaeld Çela in committing the criminal offenses of ‘Narcotics Trafficking’, in cooperation in the form of a structured criminal group ‘Committing criminal offenses by criminal organizations and a structured criminal group’ is fully proven”.
The GJKKO sentenced Saimir Tahiri to 5 years in prison for ‘Abuse of Duty’. But with a shortened trial the sentence is reduced to 3 years and 4 months imprisonment. Tahiri was convicted only for “Abuse of Duty” by ‘escaping’ the charges of “Corruption of senior officials”, “Narcotics trafficking committed in collaboration” and “Structured criminal group”.
