Sali Berisha considers the proposal of the Chief of General Staff of the Albanian Army for the post of President of the Republic, a violation of the Constitution of the country.
“It is strictly forbidden for active servicemen to be elected or appointed to other positions”, says Berisha.
“An unconstitutional act and a very dangerous precedent for the country and democracy! The Constitution of Albania in Article 167 stipulates ‘Active service servicemen may not be elected or appointed to other state posts nor participate in political parties or activities. Members of the armed forces or persons performing alternative service shall enjoy all constitutional rights and freedoms unless otherwise provided by law. ‘
This article therefore strictly prohibits active-duty military personnel from being elected or appointed to other positions. Therefore, this appointment is unconstitutional and dangerous for the present and the future of Albanian democracy.
This grave violation of the Constitution plunges the country into a serious constitutional crisis. “First of all, the Constitution in its definition is clear as crystal clear and it is taxing in its article that the active military can not be appointed and elected to other duties outside the army.”
He who believes that he can sell General Bajram Begaj as an inactive soldier, mocks the Constitution, the Army and the Albanian society, says Berisha, in a very critical reaction posted on the social network “Facebook”.
“General Begaj, who even at this moment is the chief of the general staff, ie active, is resigning or being dismissed by decree, so he is leaving the Army as an active military precisely to be appointed to a task that the Constitution does not allow.
I condemn with the utmost force this act typical of the junta and unprecedented in the history of free countries. “I condemn this act as flagrant evidence of the seizure of the state and the Constitution by a criminal organization led by Edi Rama, which has no other interests than stealing and robbing citizens.”
Berisha also has a call for the current president, Ilir Meta:
“I call on the President of the Republic to protect the Constitution and not to allow this flagrant and extremely dangerous rape of it”.
