Regarding today’s announcement on a request of the President of the Republic of Albania for the disciplinary proceedings of the members of the Constitutional Court, I assess that the request submitted by him is not based on the Constitution and the law.
The President of the Republic, trying to violate the integrity of the Constitutional Court and its decision-making, is pursuing actions contrary to the Constitution and laws. These acts, which led to his dismissal by the Albanian Parliament.
It is very clear that the decisions of a process in the Constitutional Court can not be in accordance with the “interests” of an applicant or groups which are affected by the decision of the Constitutional Court, but only in accordance with the Constitution and the law, to the “dissatisfied party” should not undertake acts which impede and test the system of guarantees of independence and impartiality of the Constitutional Court of a country.
Through this unfounded request, the President of the Republic seeks to create legal artifices regarding the development of future processes before the Constitutional Court, to prevent or block their development.
Justice reform has created and continues to create ongoing “concerns” and will consequently be accompanied by reactions or pressure by illegal means, which the new organs of the justice system must face.
Every public official must strictly adhere to the Constitution and laws in order to justify the broad public confidence in the reform of the Justice System.
