- Silvana Miho, is accused of having committed the criminal offense “Forgery of documents “,provided by Article 186/3 of the Criminal Code.
From the analysis one by one and in the data unit obtained from the results of telephone interceptions, the data obtained from the examination of the defendants’ mobile phones, the data obtained from the practices administered in the Security Academy and the General Directorate of Police State documents, other written acts and statements of persons aware of the criminal offense, or statements of the defendants, has been proven beyond a reasonable doubt based on the evidence that the defendant Dritan Lelaj provided irregular monetary benefit to the defendant Qetorët Gurra, i who on the other hand accepted this offer for irregular benefit in order to illegally influence other public officials of the Security Academy and the General Directorate of State Police to favor the defendant Dritan Lelaj in the winning result in the exam of winning the rank “Deputy Commissioner” for attending studies in the first cycle at the Security Academy, for the academic year 2021- 2022, held on 27.10.2021.
Also, it turns out that the defendant Dritan Lelaj during the examination / complaint process used a document which presented false circumstances that do not correspond to the truth, a document issued by the defendant Silvana Miho, as the person who had for duty to issue the document.
Whereas for the citizen under investigation Agim Lelaj, based on article 328/1 letter b) of the Code of Criminal Procedure, the termination of the accusation / investigation for the criminal offense was requested “Exercising illegal influence over persons exercising public functions”, Provided by 245/1 point 2 of the Criminal Code, with the reasoning that the actions committed by him can not be qualified as illegal actions that constitute the objective side of the criminal offense provided by Article 245/1 point 2 of the Criminal Code.
