The SPAK could not escape the refrain of incompetence that is often declared by courts and prosecutors.
Especially when it comes to high-level officials who, after being found out to be not involved in investigations, are considered to have escaped from the decisions of incompetence that only their subordinates forward for further investigations. This trend starts from electoral issues to the accusations of citizens for the highest levels of statesmen.
According to the data that Top Channel has within a year, in 132 cases SPAK has removed from itself cases of top officials of mortgage prisons state police to denunciations where the accused were ministers or former ministers, but in the end are found not included and therefore and SPAK has been declared incompetent.
The next minister to be declared incompetent is Milva Ekonomi, a former agriculture minister for whom the SPAK was found incompetent and sent her subordinates for further investigation.
The report against the former Minister of Economy was submitted to the SPAK on January 10, 2022 and was delegated to the capital’s prosecutor’s office three days later on January 13. It is about the denunciation of Ervin Resuli who demanded investigations for the former minister and three other senior officials, suspected of abuse of office, after according to the claimant an illegal order was issued to close the only phytosanitary laboratory in Albania.
SPAK considers that Resuli’s claims do not find support regarding the former minister, while the other three officials see that they belong to another prosecution to be investigated. The same thing has happened during these months with the former Minister of Defense Olta Xhacka, the Minister of Health, Ogerta Manastirliu, the former Minister of Reconstruction, Arben Ahmetaj, but also many others for whom SPAK has declared incompetence.
But a decision that Top Channel has since May 2021 has resolved the maneuver with incompetence. In this decision, the High Court orders that the prosecution in cases when it notices that there is no criminal offense, should request the cessation of the investigation and the possibility whether to investigate or close this case has only the court. This order of the High Court should be applicable to the SPAK as well, despite the results, it is still far from expectations.
