The SPAK ordered a ban on the publication of the testimonies of Nuredin Dumani and Henrik Hoxhaj, threatening to imprison journalists.
The letter was made public by Ora Nwes journalist Elton Qyno, who was warned by three ‘Golden Bullet’ special prosecutors that he continues to have some of the key figures in the investigation on the run.
Meanwhile, the SPAK has not yet taken an official stand to clarify what has driven it to violate media freedom in the worst case and, at best, to preserve repentance.
However with the memory of imprisoning journalists from two to six years, the Special Prosecution’s efforts are not the case to be considered to maintain investigative secrecy as long as it was deconspired at the outset, even though it might have turned into the most powerful case. .
Without finding out who revealed the secret as required by the same law and which provides for the sentence of five years in prison of a public official and also of the person in charge of maintaining such a thing, SPAK orders that the secret be kept by the media.
Citing Article 295 / a, point one of the criminal code, the prison should first be mentioned to law enforcement officials such as the police and the prosecution, who are the secret keepers and in this case the witnesses Nuredin Dumani and Henrik Hoxhaj. But since it failed, SPAK recalls points 4 and 5 of this law which provide for imprisonment from 2 to six years in case the media publishes these stories.
Without informing the public and not revealing who are the officials who betrayed the protected witnesses Nuredin Dumani and Henrik Hoxhaj and who in reading the same law risked the lives of the penitents and violated the public interest by undermining an investigation from where they should be arrested perpetrators still wanted, SPAK is the first to violate investigative secrecy when it admits that Nuredin Dumani and Henrik Hoxhaj have become collaborators of justice.
This comes at a time when the special court has ordered that no details be released about Duman and Hoxhaj. SPAK insists unofficially that the letter does not affect the media and freedom of the press as long as the law says that the details of the justice witness should not be disclosed.
But that Nuredin Dumani and Henrik Hoxhaj are witnesses of justice also says this in the document in question signed by the three special prosecutors, which the media is obliged to make transparent and tell the public.
