The Tirana court has published the reason for rejecting the request of Judge Agron Zhukri to withdraw from the review of the issue of the Statute of the Democratic Party, represented by the Provisional Re-establishment Commission.
Its clarification states that pursuant to the Code of Civil Procedure, the court may not refuse to review and issue decisions on issues before it for consideration, for the parties that initiate the court to initiate a judicial process, except when the law predicts otherwise.
The court notice states that Judge Zhukri, after being acquainted with the request, assessed that there were reasonable reasons not to participate in its review and submitted to the President of the Court the request to withdraw from the trial of the case.
Referring to the same legal basis, the President of the Court, after assessing the reasons presented for his exclusion from the examination of the case, decided not to accept the request and to continue the trial of the case by the same judge.
“The lawsuit filed in 2018, is a ground trial with plaintiff and defendant litigants, while the lawsuit filed in 2021, is a lawsuit for filing changes to the party statute filed by a group of individuals“, Is quoted from the court notice.
DP already has two statutes in the Court of Tirana. The Democratic Party Re-establishment Group and their lawyers have filed in court for registration the new statute, which was approved on December 11, in the Assembly convened by Sali Berisha. This decision comes only two days after Lulzim Basha filed in court, yes for registration the amended statute in the Assembly of the Democratic Party on July 17, although 5 months late.
The DP is facing a not at all easy situation, with 2 statutes. One made in the Assembly on July 17 and one recently made in the Assembly of Berisha on December 11. Both sides do not recognize each other’s statutes.
