The CEC has approved the SMI’s request to register as a coalition in the March 6 elections.
Among other things, Celibashi rejected the Democratic Party’s two requests for non-registration of the coalition. According to the head of the CEC, the Democrats’ demands have a logical line, but have no legal basis.
Earlier during this meeting, the legal representative of the Democratic Party, Marash Logu listed in his reasoning two elements that legally made it impossible for the CEC to register the “House of Freedom” as a coalition.
Celibashi: We consider that justifying the claims of the DP representative, first of all for the legitimacy in relation to the deadline, we are reviewing this request today and at the moment it is being reviewed, the SMI appears to be registered as an electoral subject.
The claim has no legal basis. We are reviewing and reconfirming their interest in having an electoral coalition in this election. Therefore, I assess that the request of the electoral subject SMI reviewed today to register a coalition with an electoral subject that has elected it, in my assessment has full legitimacy. Regarding the content and the material or essential part of the claim of the DP representative, I think it stands, specifically in terms of some identifying aspects whether political or electoral of this coalition. I believe that the reasoned request by the DP representative that we would be in this situation if we lacked documentation does not stand.
We have all the elements to register one political party minimally with another as an electoral subject. We consider that it is unnecessary and we are in the situation when the request composed of several aspects reflects conflict according to the provisions of Article 65/66 of the Electoral Code.
So, the PD Re-establishment Commission can not be part of the coalition, as long as it is not registered as a political party. Thus, according to the CEC, the ‘House of Freedom’ coalition will consist of only two political parties, LSI and PDK.
Celibashi: Requests to include in symbols and initials or even in its essence elements related to the PD can not be accepted because not only for the fact that Logu said that the PD lacks interest in this coalition, I think it was a follow-up of their interest in formal views. On the other hand, what matters most is the discussion of symbols or other elements that create confusion among voters. Therefore, in the final evaluation, I decide to register as an electoral subject the coalition of political parties “SMI and PDK” with the name of the coalition “House of Freedom”. The leading party is the SMI. This decision enters into force immediately and this decision can be appealed within 24 hours.
