Frank James, the man accused of attacking a subway train in New York City, will be held in jail without the possibility of parole pending trial on federal terrorism charges.
James, 62, appeared in court on Thursday on suspicion of violating a law banning “terrorist attacks and other forms of violence” against mass transit systems.
He was captured after the attack that left 23 people injured.
His lawyer has requested a psychiatric report.
If convicted, he could spend the rest of his life behind bars.
The suspect “carried out a premeditated attack on the citizens of New York during the first hours of the morning,” said US Prosecutor Breon Pearce as he read the statement on the charges.
He is accused of firing on 10 people and injuring at least 13 others.
The suspect fled the scene of the attack, but some of his personal belongings remained.
He reportedly called the police himself to tell the location, US media said, citing their sources.
In the past, the suspect has been arrested nine times in New York and three times in New Jersey.
The motives of the attack are not yet known.
