The Special Court of Appeals for Corruption and Organized Crime this Wednesday has decided to postpone the court hearing for the former Minister of Interior, Saimir Tahiri.
The reason was that the new judge, Florian Kalaja, asked for time to study the file after the resignation of Judge Daniela Shirka.
Shirka is the third judge to withdraw from the criminal case against Tahiri and the former director of the Vlora Police, Jaeld Çela, arguing that he is inconsistent after reviewing a case related to that of the former minister.
Outside the court, the lawyer, Maks Haxhia, also commented on the situation created after the resignation given on January 4 by Judge Daniela Shirka.
“The request was submitted to the court to see what the cause is, the lawyers have made a request for incompatibility not to be present Daniela Shirka that stops the procedure to participate in the same trials to avoid influence from the same case, if the cause will be the same as what we asked to exclude the trial panel “, said Haxhia.
It is learned that the next hearing will be held on January 17.
The “Tahiri” case was registered in this court on November 26. Previously this case was in charge of the Supreme Court. The latter clarified the decision on the case of the former minister, where it was argued that there were procedural violations during the trial of him and former director Jaeld Çela.
With the decision taken, the Supreme Court gave a procedural victory to Tahiri, while deciding to overturn the decision of 26 June 2020 of the Special Court of Appeal and return the case for review to another body of the Special Court of Appeal.
Tahiri was targeted by the judiciary in October 2017, after Italian authorities cracked down on a structured criminal group in marijuana trafficking, led by the Habilaj brothers – Tahiri’s relatives. The prosecution charged Tahiri with drug trafficking and demanded his arrest, but the Socialist parliamentary majority blocked the arrest request and attacked the prosecution’s investigation as biased.
In September 2019, Tahiri was acquitted of drug trafficking charges and structured criminal group, but was sentenced by the Serious Crimes Court to 5 years in prison for abuse of office, a sentence which was converted to 3.4 years due to trial cut.
The first-instance decision was overturned by the Special Court of Appeals, which remanded the case for reconsideration.
