The meeting of the council of mandates where the request for the removal of the mandate of minister Olta Xhacka was discussed was accompanied by debates.
The minister herself did not appear at the hearing, being represented by the legal defender, Genc Cifligu, for whom the arguments of 1/10 of the opposition deputies in the motion are general and leave room for abuse, so it cannot be put into motion Constitutional Court.
Cifligu emphasized that Mrs. Xhacka has not benefited from public property during the exercise of her mandate. Regarding the granting of strategic investor status to the minister’s husband, the legal defender stated that “the profitable activity of the deputy’s husband does not result from state or local government assets” and that there is no contract or sub-contract between the husband’s company of deputy Xhaçka and any public institution.
“The company received the status after fulfilling the legal requirements. The surface is completely private. It turns out that the company will not use the sea and the surrounding area, but it is another company that will sign the corresponding contract for the use of the seashore. So, in the specific case, the activity does not result from state assets, referring to the decision, it is not foreseen that there will be any future contractual relationship, this relationship can be carried out by the other company.” Çifligu said.
“In the legal provisions and the decisions of the Constitutional Court, there are no references to the incompatibility or not of the MP’s function with the holding of functions in the private sector by their family members.
In no provision of the constitutional or legal provisions, there are no regulations that, on the one hand, equate the behavior of the member of parliament’s family or spouse with the behavior of the member of parliament mandated by his electorate for what he personally represents or may infringe the right to was chosen with the presumption that in the future the husband of the MP could potentially have benefits.” Cifligu continued.
But his arguments have brought the reaction of the opposition MPs. Gazment Bardhi said that he did not come to this meeting to hear the advertisement of the minister’s husband’s company, but the procedure of granting the status of strategic investor.
White: If he has come to do the business lawyer, do it outside. I did not come to listen to his tales
Nicholas: If you don’t want to, you can leave the meeting. We came as usual to listen, I am not impressed with these interventions. Sit down or go outside if you are agitated.
