Cifligu emphasized that Mrs. Xhacka has not benefited from public property during the exercise of her mandate. Regarding the granting of strategic investor status to the minister’s husband, the legal defender stated that “the profitable activity of the deputy’s husband does not result from state or local government assets” and that there is no contract or sub-contract between the husband’s company of deputy Xhaçka and any public institution.
“The company received the status after fulfilling the legal requirements. The surface is completely private. It turns out that the company will not use the sea and the surrounding area, but it is another company that will sign the corresponding contract for the use of the seashore. So, in the specific case, the activity does not result from state assets, referring to the decision, it is not foreseen that there will be any future contractual relationship, this relationship can be carried out by the other company.” Çifligu said.
“In the legal provisions and the decisions of the Constitutional Court, there are no references to the incompatibility or not of the MP’s function with the holding of functions in the private sector by their family members.
