“Favored the criminal group Habilaj” / Reasoned decision for former Minister Saimir Tahiri becomes clear

Following the publication of the reasoned decision of the Court, the way is now open for recourse to the High Court. Recourse that was previously announced by the defense lawyer of the former minister, Maks Haxhia.

The court reasoned that the wiretapping of the people of the criminal group Habilaj, who talk about Saimir Tahiri, is evidence, as their conversations are sincere, as they have no knowledge that they are being wiretapped. On the other hand, it turns out that the prosecutor’s conclusion that the Habilaj Criminal Group started its criminal activity when Saimir Tahiri became a minister, after he had committed the criminal activity earlier, is not true. But the inclusion of Tahiri as part of the group made it easier for them to be trafficked.

It is proven beyond any reasonable doubt that the gifts were purchased for Tahiri, but it does not prove beyond any reasonable doubt that defendant Tahiri received these gifts as a reward. The court decision also states that the family of the former minister had contacts with the criminal group. According to the Court, Tahiri’s vehicle was used for two years by the criminal group and with unchanged ownership, conscientiously favoring the criminal group.

After a marathon session, the GJKKO sentenced Saimir Tahiri to 5 years in prison for ‘Abuse of Duty’. But with a shortened trial the sentence is reduced to 3 years and 4 months imprisonment. Tahiri was convicted only of “Abuse of duty” by ‘escaping’ the charges of “Corruption of senior officials”, “Trafficking in narcotics committed in collaboration” and “Structured criminal group”.

In the arguments of the decision, the Appeal of GJKKO underlines that it turns out that Tahiri has connections with Moisi Habilaj and Artan Habilaj and these connections have influenced the criminal group to infiltrate the ranks of police and state employees and hinder the fight against drug trafficking.
