Sessions have resumed in the Constitutional Court for the dismissal or not of the President of the Republic Ilir Meta.
President Ilir Meta himself did not participate in today’s court session. The Head of State is represented in this session by his Legal Advisor, Bledar Dervishaj and the Legal Director, Katrin Treska.
With the resumption of the session, the legal defender of President Ilir Meta, Bledar Dervishi said that the investigation process against the president is illegal and in violation of the constitution.
He said that Erind Mërkuri, elected by the parliament as an independent expert in the investigative commission, is participating in the session today as an authorized representative, but the representative of the majority, Klotilda Bushka, said that Mercuri was a constitutional expert on the nature of law.
Debate with the resumption of the session
Bledar Dervishi: The action of the authorization by the President of the Assembly is another concern for the President of the Republic and the court should take into account in examining the merits of the case for the fact that the assembly, if I am not mistaken, elected him as an independent expert during the parliamentary investigation process. This is another proof of how independent the assembly has been, how political it has been in this initiated process, legally evaluated by the law commission and then by that structure considered investigative. This is the next proof that the whole investigative process against the president, this puts a stamp of impartiality on the violation of the constitution, the violation of the basic principles of the rule of law, the regular legal process. So there is no list of principles that has not been violated.
Klotilda Bushka: Mr. Erind Mërkuri was a legal expert during the investigation process in the Albanian Parliament and was taken as an expert in constitutional law regarding the issue of justice. It has not commented on the decision-making of the Assembly and today under the nature of the authority it has is only to comment on questions. We do not think we are in a state of bias. There are no allusions to independence issues or one-sided positions in this process.
Erind Mercury: His summons is obligatory. The Assembly has the obligation to convene the president. But having said that, the Assembly is not bound to host the President.
Klotilda Bushka: It is indisputably an obligation, the notice to attend this session, as well as the request for the process of a request for the dismissal of the republic to be taken seriously. It is my duty to make this announcement within objectivity, but on the other hand the process must go. It’s a serious request and should not end there. The president has been offered the opportunity to be on the Law Commission. We are also referring to the president’s requests to participate in the Law Commission.
Erind Mercury: It is not clear why the president did not appoint a representative in this case, given the seriousness of the issue. (Presence in the law commission)
Question nine, These are the rules of legislative technique, as a rule of writing in the singular also means the plural. The Assembly does not conduct a criminal investigation. This belongs to the prosecution. It is the prosecution that investigates, in our case the special prosecution. If the president was to be found guilty, then parliamentary proceedings came into play and if it constituted a crime, whether it was a serious crime or not. Since in this case the president’s actions were made public and there was no need for an in-depth investigation, deadline 3 weekly is considered sufficient.
