The former Minister of Justice, now a deputy of the Democratic Party, Fatmir Xhafaj has analyzed the activity of the justice systems in the country, KLP prosecutors or SPAK, in the Law Commission.
In his speech at the Laws Commission, Xhafaj said that there are 5 concerns that must be taken seriously by the justice system, starting with the independence of the institutions. According to him, they are not independent, but under the influence of internal or external factors. He said that another concern is accountability and transparency, which according to him are clearly missing in this system, since they do not often appear in statements. As a fourth concern, Xhaferraj mentioned the relations between the institutions, where he mentioned the KLP, which according to him has no communication with the General Prosecutor’s Office. The last concern for Xhaferraj has to do with crimes and their prevention.
“Today we are very demanding about the expectations we have with these institutions. The expectations of the citizens towards the justice reform. When we talk about the criminal justice system, this expectation is much higher, even more so of SPAK and the High Prosecution Council. We are in the third year of their function, they are already guaranteed, but in practice, in the way they operate, they are far from being independent, more influenced by external and internal factors. We have given them all this support, but we have to guide them towards the instruments. It looks like it’s the Institute of Justice. The KLP, the head of the special prosecutor’s office, should better evaluate the performance of the work efficiency of each prosecutor and the quality of investigations, but also the management of the criminal justice system. I think there are a number of problems related to their managerial ability. The general or district prosecutors have a very important function to manage these structures. The problems are related to the management role of these structures. One can be a good prosecutor, but management skills are also needed. We cannot make the same recommendations as in the first year, as now. Our recommendations should be reflected here. Even the draft presented for the draft resolution, we do not ask the prosecution, we recommend it. This is the determination made by the constitution and the law. We must also share the priorities of the prosecution institution. I say that there are 5 concerns that need to be reflected, the first is independence, measures for responsibility and accountability, transparency of public communication.
